1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and ClinVPN ("ClinVPN", "we", "us"). They cover the ClinVPN website, the ClinVPN apps ("App") and the related network and services (together, the "Service"). By downloading, installing or using the Service you agree to these Terms. If you don't agree, please don't use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. If you install the App on a device or network you don't own, such as a work computer or a shared connection, you confirm that you have the owner's permission, including for the Value Exchange.
3. The Service
ClinVPN routes your internet connection through the ClinVPN network so that websites see a ClinVPN address in the location you choose instead of your own. The Service is in public beta: features may change and it may contain bugs. A VPN helps protect your privacy, but it does not make illegal or harmful activity acceptable or protected.
4. Licence and updates
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use. You must not copy, modify, resell or reverse engineer the App, or tamper with its security or network features.
The App updates itself automatically to fix bugs, improve security and add features. Updates are covered by these Terms.
5. Value Exchange
ClinVPN Free is free because of the Value Exchange. When you use the free version, your requests are routed through the ClinVPN network and, in return, your device becomes part of that network: while the App is running, other users of the ClinVPN network, including business customers who use it as a proxy network, may route internet traffic through your device's connection and IP address.
By using ClinVPN Free you consent to this use of your device's network connection and resources. In particular:
- We make our best effort to use your device's resources only while they are idle, and to keep your own browsing the priority.
- Traffic routed through your device is carried to the public internet only. It cannot access your files, your apps or other devices on your local network.
- Websites may see this traffic as coming from your IP address, and it counts towards any data allowance on your connection.
- Traffic routed through your device may be used by the Areal InfoTech proxy network, whose business customers use it for public web data collection under an acceptable use policy that prohibits illegal activity.
- You confirm that your internet provider's terms, and the owner of the device and network if that isn't you, allow this use.
If you don't want to take part in the Value Exchange, you can close or uninstall the App at any time, and sharing stops as soon as the App isn't running. Once Premium launches, you will also be able to upgrade and use ClinVPN without sharing your resources.
6. Acceptable use
Use ClinVPN only for lawful purposes. You must not use it to:
- break any law that applies to you;
- access, create or share child sexual abuse material;
- hack, scan or attack systems, spread malware, or take part in denial-of-service attacks;
- send spam, or run phishing, fraud or other scams;
- harass or threaten anyone, or infringe anyone's rights.
We will suspend access that breaks these rules and cooperate with authorities where the law requires.
7. Premium and fees
ClinVPN Free costs nothing. When Premium becomes available, its price, billing, renewal and refund terms will be shown to you before you buy, and you will never be charged without agreeing first.
8. Your data
To run the Service we collect limited technical information, such as your IP address, a random installation ID, your device and app version, crash reports, and connection records like time, location used and data volume. We use it to operate and secure the network, prevent abuse and improve ClinVPN. We don't record the content of what you browse and we don't sell your personal data. Questions: support@clinvpn.com.
9. Intellectual property
The Service, the App and the ClinVPN name and logo belong to ClinVPN or its licensors. These Terms don't give you any rights in them beyond the licence in section 4.
10. Disclaimer and liability
The Service is provided "as is" and "as available", without warranties of any kind. We don't guarantee that it will be uninterrupted, error-free or able to reach any particular website. To the maximum extent permitted by law, ClinVPN is not liable for indirect or consequential losses, and our total liability for any claim is limited to the greater of the amount you paid us in the previous 12 months or USD 10.
11. Termination
You can stop using ClinVPN at any time by uninstalling the App. We may suspend or end your access if you break these Terms or if your use puts the Service, other users or third parties at risk.
12. Changes
We may update these Terms. We'll change the date above and, for important changes, let you know through the website or the App before they take effect. Continuing to use the Service after that means you accept the updated Terms.
13. Disputes and contact
If you have a problem with ClinVPN, please contact us first at support@clinvpn.com. We'll try to resolve it informally within 30 days. Nothing in these Terms takes away any rights you have under the consumer protection laws of the country you live in.
